Lawyersrepresenting two men recently implicated in a 2006 murder in Mount Carey, St James, are expected to apply for bail when the matter returns to the Montego Bay Resident Magistrate's Court on June 25.
The court was informed on Wednesday that the main witness in the matter against Devin McPherson, 31, chef, and Rohan Williams, 33, mason, both of Mount Carey, could not be found.
However, the prosecution believes he can be located. The court was also told the prosecution was awaiting DNA result to complete its case file.
Resident Magistrate Vivienne Harris told defence attorneys Roy Fairclough and Morrel Beckford that she would hear bail applications at the next hearing when the court gets information about the witness.
Williams was arrested last December McPherson arrested in April. They were accused of being involved in the shooting death of Anthony Kentish, also of Mount Carey.
Allegations are that about 7:30 p.m. on November 27, 2006, Kentish and a witness were driving towards Williams' house in York Bush, Mount Carey, when they were signalled to stop by a vehicle.
It is said that McPherson was driving the vehicle while Williams and an unidentified man were passengers. Williams and Kentish spoke outside and later both cars were driven to McPherson's home. The witness stood outside the house while the two accused men and Kentish went inside. They were later joined by four other men.
wrong time
Further allegations are that one of the unidentified men told the witness to go inside the house. The witness was told to lie on the floor and was tied up. One of the men allegedly told him he was in the wrong place at the wrong time and was asked if anyone knew he was coming to the house.
The court was further informed that the witness was relieved of his car key and cellular phoneand was placed in the trunk of his car. The men also placed Kentish, who appeared to be dead, with his hands bound and lower body wrapped in a plastic bag, inside the trunk beside the witness.
The witness alleged that the men were discussing how they would dispose of him and Kentish.
The men were taken to a section of Wales Pond in St James where it is alleged that the two accused threw Kentish's body into a gully. They then took the witness elsewhere and pushed him down a gully. He managed to free himself and ran.
escaped
He alleges that he heard explosions as he escaped. He reported the matter to the police the following day and took them to Kentish's body. The body had a gunshot wound to the head and bruises to the chest and hands.
The police allege that they went to the homes of both accused men but were unable to locate them. *lo** was allegedly found at McPherson's home.
