Tesha Miller hearing for RM court

A hearing on the release application of reputed Clansman boss Tesha Miller is expected to be brought up in the Corporate Area Resident Magistrate's Court today.

His attorney, Valerie Neita Robertson, who filed a writ in court demanding Miller's release, appeared in court last Thursday and brought up the issue for the third time. Senior Resident Magistrate Judith Pusey was to rule on whether or not she had the power to grant the alleged gang boss release from custody but it was postponed until today.

The matter has so far been postponed three times since Miller surrendered to the police on May 31 after the police released a list of alleged gang leaders and members from various communities in the Corporate Area and St Catherine.

Miller is being held under the Emergency Powers Act which is being enforced as part of the state of emergency.

Police sources say under the State of Emergency Act, detainees can be held indefinitely without charge but Neita Robertson argued in court that her client is from St Catherine and as such is not affected by the limited state of emergency which has been imposed for just about a month in Kingston and St Andrew.
